We subscribe to the above doctrine expressed by Lord Clyde as long ago as 1929, in the case of Ayrshire Pullman and Ritchie Motor Services v CIR, that a tax payer is entitled to arrange his affairs in such a way as to minimise his or her exposure to taxation.

Tax avoidance is, in our view, a totally legitimate exercise although it must not be confused with tax evasion which is clearly illegal.
